On Friday, April 11, 2011, E. Martin Knepper, Esquire and Barbara H. Stratton, Esquire attended the Delaware Trial Lawyers PIP and UM/UIM annual seminar on the latest cases and changes in the laws in the last year.
One topic of note was the recent push by some insurance companies to contractually shorten the statute of limitations for making uninsured and underinsured claims to two years from the date of the loss. This flies in the face of the current case law which has established the statute of limitations in uninsured and undersinsured cases as three (3) years from the date of denial of the claim.
